徐國堯，消防員，出面檢舉長官貪汙，辦遊行控告消防局強迫消防員加班，檢舉人身分遭外洩，並在3個月內被記了42支申誡遭到免職處分，至今仍在上訴。

法務部廉政署草擬的《揭弊者保護法》草案已經出爐，並送交行政院審議，其目的在於貫徹政府肅貪的政策，並鼓勵及保護揭露不法行為的揭弊者，因此又被稱為「吹哨者法案」。草案中明文禁止對揭弊者的「三大報復」：一是對揭弊者的身分、官職、薪俸作不利對待；二則對進行中的契約終止或變更，或是實施強暴、脅迫、侮辱或騷擾等行為；第三是揭弊者若認為受到報復，行政救濟可依公務員保障規定，申訴後不負舉證責任，由機關提出說明，並讓揭弊者在認為有危害時可聲請保護書保障，被檢舉人若是違反保護書的規定，將可處3年以下刑責。法案中對揭弊者的保護擴及親屬、利害關係人，若揭弊者有人身安危的疑慮，並可申請人身保護。
有了這套《揭弊者保護法》，吹哨者似乎能夠得到法律上的保護，但重點來了，它真的管用嗎？
《揭弊者保護法》草案裡的保護在我看來還是太消極，想想看前面提到的蕭曉玲、葉繼元、徐國堯、林于凱，還有我，我們這些「軟性的倡議者」都會面臨不同的職場打壓，那麼挺身揭弊的吹哨者，面臨的情況自然可想而知。吹哨者最大的困境來自於公部門上對下的權力關係及職場氛圍，經常使得吹哨者無法繼續待在原機關，甚至非得離開公部門不可。但法案中，政府卻沒有擔負起幫助他們轉職或安置生活的責任，挺身揭弊到頭來卻落了個被用過就丟的下場，叫人情何以堪？
再者，《揭弊者保護法》並未溯及既往適用，那些以前為政府揭弊的吹哨者們付出了代價，卻沒有得到該有的對待，那以後誰還敢吹哨子？政府反貪肅貪到底是玩真的還是玩假的？
